هيئة مقاومة الجدار والاستيطان، ومركز القدس للمساعدة القانونية: مخطط النويعمة لتهجير البدو هو مخطط تطهير عرقي

اودعت الادارة المدنية للاحتلال خلال شهر اب الماضي، ستة مخططات للاعتراض، مقترحة مواقع متقاربة جدا في منطقة النويعمة باريحا لتكون قرية جديدة للسكان البدو من الفلسطينيين، الواقعة مضاربهم ما بين القدس والاغوار. تأتي هذه المخططات على اراض مصنفة (ج) وفقا لاتفاق اوسلو، وتقع على الخط المحاذي لمدينة اريحا. ورغم ان الادارة المدنية طرحت المخططات بشكل منفصل، لكنها في الواقع خطة واحدة متكاملة تشمل طرقا توصلها ببعضها، وتنضم الى المخططات الاربعة الخاصة بتوسيع شارع المعرجات (رام الله – اريحا).
ان الفلسطينيين بكافة اطيافهم وانتماءاتهم يجمعون على رفض هذه المخططات، ليس فقط لانها تمثل تهجيرا جديدا للبدو المهجرين اصلا من اراضيهم عام الـ 1948، اولا لانها ستقوض نمط الحياة الخاصة لشريحة اصيلة من شرائح المجتمع الفلسطيني، بل ايضا لانها تشكل تطهيرا عرقيا للفلسطينين المقيمين على مساحات من الاراضي الفلسطينية الواقعة شرق وسط الضفة الغربية والتي تتواجد عليها العشائر البدوية، وتخصصها لاغراضها الاستعمارية الاستيطانية. تنفيذا للمخطط الاستيطاني المعروف ب E1 .
وعليه فاننا ندعو كافة المستويات الفلسطينية والمؤسسات الدولية الى مواجهة هذا المخطط بكل السبل الممكنة والمتاحة من قانونيا وجماهيريا وسياسيا ودبلوماسيا واعلاميا. مدركين في الوقت ذاته ان التصدي الشعبي لهذا المخطط سيكون له الاثر الابرز والاهم على صمود البدو وحماية ارثهم وثقافتهم ووجودهم. مثلما يشكل رافعة للوقوف امام تنفيذ المحاولات الاسرائيلية في فرض مخططاتها الاستيطانية وخصوصا منها المخطط المعروف ب E1 .
ان تصاعد الهجمة الاستيطانية التي تشنها الحكومة الاسرائيلية الحالية سواء عبر مصادرات الاراضي كما يحدث في بيت لحم والخليل. او الاستمرار في سياسات الهدم والاخلاء وتهويد القدس . لن تثني الفلسطينيين عن المضي في تحقيق هدفهم باقامة دولتهم المستقلة على الاراضي الفلسطينية المحتلة عام 1967. وهذه المخططات الهيكلية الاستيطانية في جوهرها، وان هدفت الى منع قيام الدولة الفلسطينية، وتقسيم الضفة الغربية الى معازل ومنع التواصل بين شمال وجنوب الضفة الغربية عبر تنفيذ مخطط E1 ، انها لن تفلت من اصرار شعبنا على نيل حقوقه المشروعة. اننا واذ نستهجن وندين مشاركة شركات فلسطينية في تخطيط هكذا مخططات، حتى وان لم تكن تعي خطورة ما تقوم به، فاننا نطالبها بالتراجع عن تلك المخططات، وتقديم اعتذارها للشعب الفلسطيني كما اننا نرى ان عدم مواجهة هذه المخططات سواء فلسطينيا او دوليا تجعل من الجهود الدولية من اجل السلام والتنمية وانهاء الاحتلال، مجهودا غير مجد. ولهذا فان المطلوب ممارسة الضغط الفعلي على اسرائيل من اجل وقف هذه الجريمة الجديدة، والخطيرة التي تستهدف الارض الفلسطينية اولاً، والشريحة البدوية من الشعب الفلسطيني ثانياً، ومستقبل الدولة الفلسطينية ثالثاً.

The Colonization and Wall Resistance Commission, together with The Jerusalem Legal Aid & Human Rights Center -JLAC- urgently call the Israeli Authorities, International Community and all competent authorities to halt immediately and permanently the ethnic forced transfer of Palestinian Bedouins.
We denounce that the Palestinian Bedouins are facing a preconceived campaign to push them off their ancestral way of life and identity, into a series of concentration “townships”, forcibly urbanizing them and depriving them of their traditional sources of livelihood, as part of a prolonged Ethnic Cleansing and annexation of land strategy.
Israeli authorities recently published six plans to be implemented in the near future, for the ethnic forced transfer of Palestinian Bedouins from their home communities located in the surrounding areas of Jerusalem, Ramallah and Jericho, into the Nuwei´mah area, an adjacent area of Jericho district. We highlight that this is a gross violation of the international law. Which prohibits the forcible transfer of "protected persons", such as these communities, excepting the case of doing it for their own safety or for an urgent military need. Even then, it is permissible only on a temporary basis. Both exceptions are not applicable in this case.
The Nuwei´mah Master Plan, which includes the plans of Rashayda Gharbyeh (1417-1, 1417-2, 1417-3), Rashayda Sharkya (1418, 1418-1) and Abu Zheman (1419) demarcate an insufficient area for the relocation of a yet non revealed number of Palestinian Bedouins. The described area is squashed between the Yitav illegal settlement, a military camp, a check point and an inhabit area of Jericho. This represents a risk for overcrowding, clashes with the IOF and the settlers, and lack of grazing possibilities exposing the Bedouins as cheap labour in Israeli settlements.
We warn on the risk of the fact that, the proximity of the bedouin communities to the boundaries of Jericho will potentially absolve Israel of its sphere of responsibility regarding the guarantee of basic needs and services for the Palestinian Bedouins relocated in this area.
The Palestinian refugee Bedouins are already the poorest sector of the population, many of whom live in unrecognized villages, thus are denied basic services such as electricity, water and sanitation, education and healthcare. They continuously face demolitions of any solid infrastructure they build, including demolition and confiscation of infrastructure facilitated by international donor-funded projects. As all Palestinians living under occupation, they have dealt with eviction and demolition orders and found their communities reclassified as firing, military zones and most recently in urbanizing development projects such as the E-1 plan.
As the Coordinator of Government Activities in the Occupied Territory Unit COGAT, subordinated to the Ministry of Defense of Israel, recently stated in the Knesset, “these plans aim to evacuate the Palestinian Bedouins from the E-1 area”
The E-1 master plan covers approximately 3000 acres of land stretching from East Jerusalem to Ma’ale Adumim illegal Israeli settlement, and in its different phases includes the development of a circuit of connecting roads, new house units, tourism facilities, commerce and regional services infrastructure, a regional cemetery and more.
The implementation of the E-1 plan would have major consequences on Palestinian population, it will exacerbate the isolation of Jerusalem from the rest of the West Bank and disrupt the territorial contiguity between the northern and southern areas of the West Bank. It will have a great impact on the Palestinian economy and social development as well as it will undermine the creation of a Palestinian State, ending the possibility of a Two State Solution for Palestinians and Israelis.
We declare that once more, the Israeli Government is showing its true political intentions by the imposition of discriminatory and segregating policies against the Palestinians. And once again it is incurring in the violation of the international humanitarian law.
ñ According to the Hague Regulations and the Fourth Geneva Convention, Israel, As the occupying power, is obligated to safeguard the homes of the protected persons. -Israel is bound by the Fourth Geneva Convention relative to the protection of civilian persons in time of war, to which Israel is signatory-.
ñ Article 53. of the Fourth Geneva Convention prohibits destruction of property that is not justified by military necessity. The Convention also prohibits the transfer of an occupying power´s civilians population into the territory it´s occupying and the transfer of an occupied civilian population out of its territory, and,
ñ Article 49. stipulates: “Individual or mass forcible transfers, as well as deportations of protected persons from occupied territory to the territory of the Occupying Power or to that of any other country, occupied or not, are prohibited, regardless of their motive.”
While Israel has claimed that the Fourth Geneva Convention does not apply to the Occupied Palestinian Territory, the international community has rejected such claim, including the UN Security Council and the International Court of Justice (ICJ). Further, the Hague Convention of 1907 calls on state parties to respect, protect, and fulfill family honor and rights, the lives of persons, and private property, as well as religious convictions and practices.
We demand the State of Israel to:
ñ Immediately and permanently halt the ethnic forced transfer of Palestinian Bedouins including the E-1 and Nuwei´mah Master Plans and their sub-sequenced plans.
ñ To dismantle its system of institutionalized discrimination over the Palestinian people, to repeal all discriminatory laws;
ñ To act accordingly and respect the international humanitarian law and international and bilateral agreements regarding the safeguard and respect of the human rights of the Palestinian people.
ñ To cancel all eviction orders against Bedouins in the Jerusalem periphery, Jordan Valley and all area C, and preserve the existence and livelihood of Bedouin communities.
ñ To transfer the power and responsibilities related to planning and zoning in the West Bank, including Area C, to Palestinian jurisdiction in accordance with international law and allow a planning system that includes community participation in all levels of the planning process.
